中国出台新办法，严打三非外国人

2012年5月15号起到8月底，北京市公安局开展“清理三非外国人百日专项整治行动”。6月30号，第十一届全国人大常委会表决通过了《中华人民共和国出境入境管理法》。中国公民、法人或其他组织一旦发现有非法入境、非法居留、非法工作的外国人，应及时向当地公安部门举报。NcCRainbow Mandarin 彩虹汉语

根据新的出境入境管理法，外国人非工作类签证的有限期最短为180天，最长为5年，工作类居留证件的有效期最短为90天。非法居留的外国人将给予警告，情节严重的将处每非法居留一日五百元，总额不超过一万元的罚款，或是五日以上、十五日以下的拘留。容留、藏匿非法入境、非法居留的外国人，协助非法入境、非法居留的外国人逃避检查，或者未非法居留的外国人违法提供出境入境证件者，处两千元以上、一万元以下罚款。情节严重者，处五日以上十五日以下拘留，并处五千元以上、两万元以下罚款。情节严重者，处五日以上十五日以下拘留，并处五千元以上、两万元以下罚款。NcCRainbow Mandarin 彩虹汉语

而外国人若从事与停留与事由不相符的活动，或是其他违反中国法律、法规的情形，可以限期出境。外国人违反本法规定，情节严重者，尚不构成犯罪的，公安部可以将其驱逐出境。而被驱逐出境的外国人，自被驱逐出境之日起十年内不准入境。NcCRainbow Mandarin 彩虹汉语

《了望东方周刊》认为，三非问题在中国突显，客观上说明了中国国力的上升。根据人民日报报导，中国各大城市都有许多外国人聚居，如北京的韩国城、上海的日本人群居区、广州的非洲人群居区等。2011年，全国公安机关查处三非外国人高达2万余人次，违法主体包括临时访中人员、三资企业人员、留学生等，涉及的100多个国家当中，前五名是韩国、美国、加拿大、俄罗斯以及日本。其中非法居留的案例最多，而在非法就业方面的案例主要是外语教育、涉外演出、涉外家政、劳动密集型产业等，并且多半是以留学、访问为由入境。NcCRainbow Mandarin 彩虹汉语

此外，也有涉及言论自由的案例。2011年，在上海复旦大学学习的瑞典留学生应斯文（Sven Englund），因为在网上发表文章批评中国没有民主、没有言论自由，并且发起要求自由的快闪活动，还邀请胡锦涛参加，中国当局以“妨害社会管理”为由将其驱逐出境。应斯文之后转往台湾学习。NcCRainbow Mandarin 彩虹汉语
